NEW DELHI, Sep 21 : Senior Advocate Kapil Sibal on Monday urged the Supreme Court to urgently list a plea filed by Trinamool Congress leader Mamata Banerjee challenging the Election Commission of India’s (ECI) decision to freeze the All India Trinamool Congress (AITC) name and its reserved ‘Flowers & Grass’ symbol amid a dispute between rival factions.
Sibal sought urgent listing of the matter, questioning the ECI’s decision to freeze the party’s name and symbol midway through its notification process.
Chief Justice of India Surya Kant said both sides would be heard and assured that the matter would be listed.
Banerjee’s plea challenges the ECI’s September 18 interim order restraining both factions from using the ‘All India Trinamool Congress’ name and the ‘Flowers and Grass’ symbol pending a final decision under the Election Symbols (Reservation and Allotment) Order, 1968.
The ECI has allotted alternative names and symbols to the two factions for the upcoming October 6 Assembly bypolls.
The faction led by Banerjee has been allotted the name ‘Mamata All India Trinamool Congress’ and the ‘Football Player’ symbol, while the rival faction led by Ritabratra Banerjee has been allotted ‘Democratic Trinamool Congress’ and the ‘Envelope’ symbol.
